Supreme Court Upholds Donald Trump’s Travel Ban 3.0, Says POTUS ‘Possesses An Extraordinary Power’

People arrive at John F. Kennedy (JFK) global airport following an announcment by the Supreme Court that it will take President Donald Trump's travel ban case later in the year on June 26, 2017 in New York City. There were many court movements in between, as well as revised versions of the so-called travel ban.

The U.S. Supreme Court on Tuesday affirmed President Donald Trump's authority to restrict foreign nationals from entering the country, upholding a controversial ban on travelers from seven countries.

The Supreme Court has upheld President Donald Trump's travel ban in one the most highly anticipated decisions of this year, saying the ban is "squarely within" the president's authority. He wrote that presidents have substantial power to regulate immigration.

"Under these circumstances, the government has set forth a sufficient national security justification to survive rational basis review", the court said. 'While the ACS is strongly committed to assuring the safety of the nation, it does remain concerned, as we expressed in January 2017, about the potentially chilling effect travel bans could have on the scientific enterprise, ' says the organisation's spokesman, Glenn Ruskin.

The ban blocks citizens of Iran, Libya, North Korea, Somalia, Syria, and Yemen, and some Venezuelan government officials and their family members, from obtaining a broad range of USA immigrant and non-immigrant visas. With the frequency of Trump's broadsides against the justice system and the rule of law, it shouldn't be long at all.

The court, ever mindful of the impact of its rulings across not just the country but the world, wanted to make very clear that in upholding Trump's travel ban, it was not sending any sort of signal about its own views on Islam or religion more generally. They are Syria, Libya, Iran, Yemen, Chad, Somalia, North Korea and Venezuela.

Mr Trump tweaked the order after the 9th U.S. circuit court of appeals in San Francisco refused to reinstate the ban.

The campaign of Senate Majority Leader Mitch McConnell, R-Ky., who for 10 months kept the Republican-controlled Senate from voting on President Barack Obama's nominee to the court after the death of Justice Antonin Scalia in 2016, celebrated by posting a picture on Twitter.

Opponents - and the court's liberal-leaning justices - decried what they saw as a measure targeting Muslim countries, and referred back to Trump's anti-Muslim statements during his election campaign. He argued there was evidence that the government "is not applying the Proclamation as written", citing examples of "anti-religious bias".

"And for the court to say the court of national opinion overturns Korematsu - we can't wait around for national opinion to overturn this decision", she said.

"I think he's going to tout this as a vindication of his general immigration priorities", Yale-Loehr said.

The court, she wrote, was "blindly accepting the Government's misguided invitation to sanction a discriminatory policy".

The American Civil Liberties Union compared Tuesday's ruling to the 1944 Supreme Court decision that allowed the federal government to imprison Japanese Americans, calling both moves "shameful chapters of US history".

The president's first travel ban, issued right after he took office, was blocked by several USA courts.
