Kavanaugh Denies Calling Roe v. Wade Unsettled in 2003 Email

Kavanaugh made it clear where his loyalties lie. "Make them public? I don't think you do!"

Booker responded: "I'm saying I'm knowingly violating the rules".

"We were surprised to learn about Senator Booker's histrionics this morning because we had already told him he could use the documents publicly", Burck said by email.

Kavanaugh said he was referring not to his own views but to the "views of legal scholars". He says, "the signs and signals are plain".

Democrats need at least two GOP defections to have any chance of defeating the nomination.

The questioning of Kavanaugh has carried strong political overtones ahead of the November congressional elections. "A judge must interpret the Constitution as written, informed by history and tradition and precedent", he said.

Judge Kavanaugh's hearing will resume Wednesday.

The 15-year-old email underscored a dispute that has dominated part of the hearing over Kavanaugh's unusually long paper trail stemming from his years in the Bush White House.

Murray asserts that if Kavanaugh is confirmed to the court, "Roe v Wade will be overturned". But he said the Supreme Court had affirmed it in subsequent cases.

Harris asked Kavanaugh: "Have you had any conversation about Robert Mueller or his investigation with anyone at that firm?" "In that article, you said that a president should not be subject to investigations while in office".

Harris promised to follow up with Kavanaugh on the topic.

Meanwhile it was shown, in an email obtained by The Associated Press, that Kavanaugh had taken a different tone on a 2003 abortion case than he had during Wednesday's hearing when he stressed how hard it is to overturn precedents like Roe.

Cory Booker defied Senate Judiciary Committee rules, posting to his Twitter account four emails "about racial profiling" designated "committee confidential" related to Judge Brett Kavanaugh's Supreme Court nomination.

In the hearing, Booker referenced a handful of documents and emails from Kavanaugh's time as a White House counsel, during which Kavanaugh discussed racial profiling among other topics.

Sen. John Cornyn (R-Texas) seemed exasperated as Booker went on about violating Senate rules.

In other cases, the Senate merely considered expulsion proceedings but either found the given member not guilty or failed to act before that member left office.

Democratic Senator Mazie Hirono of Hawaii also tweeted in support of Booker, saying: "Yesterday, I referred to a "Committee confidential" document where Judge Kavanaugh questioned the validity of programs that benefit Native Hawaiian programs, and by extension, Alaska Natives".

Kavanaugh underwent a 12-hour session of questioning that ended late Wednesday.

If appointed, it is possible Kavanaugh could be called upon to rule on a challenge to special counsel Robert Mueller's Russian Federation investigation.

On Wednesday, Kavanaugh answered questions about his views on executive power, abortion, and gun laws, but mostly declined to comment on issues that could be part of a future case before the Supreme Court.
