U.S. Supreme Court Rejects Net Neutrality Appeals After Year DelayMore

Providers complained that the rules were overly burdensome and a violation of the FCC's congressionally granted powers; consumer advocates said the rules were necessary as a vital consumer protection.

A federal circuit court of appeals in Washington, D.C., upheld those rules as legal - though under the Trump administration the FCC has canceled them.

The US Supreme Court has refused to hear a challenge to the net neutrality rules that were introduced in 2015, and which have since been rescinded.

While the Trump-era FCC has since repealed net neutrality, companies such as AT&T and Verizon brought the appeals court ruling to the Supreme Court along with six other cases, all in the hopes of officially removing the court's decision supporting net neutrality.

Solicitor General Noel Francisco said injunctions by three lower courts have prevented the administration from ending the program, which the Trump administration says has only encouraged people to try to enter the United States illegally.

Conservative Justices Samuel Alito, Neil Gorsuch and Clarence Thomas would have granted the industry's request. Neither Chief Justice John Roberts nor new Trump appointee Brett Kavanaugh participated in the decision.

The Trump administration overturned net neutrality regulations past year.

The FCC voted 3-2 in December along party lines to reverse the rules adopted under Obama that had barred internet service providers from blocking or throttling traffic, or offering paid fast lanes, also known as paid prioritization.

Roberts may have had a financial reason for recusing.

The legal battle over net neutrality will continue and could potentially reach the Supreme Court again in a separate case. However, the court's choice reveals how three conservative judges would rule against prior precedent on net neutrality, with Kavanaugh likely following along based on his prior opinion on the matter.

The lower court rulings left the 700,000 protected but prevented any more from registering for the program. After the repeal was finalized earlier this year, the FCC and the Department of Justice asked the Supreme Court to declare the prior decision "moot" and scrap it.
