U.S. charges Chinese tech giant Huawei, top executive

The US Department of Justice on Monday charged Huawei with theft of trade secrets, wire fraud and obstruction of justice. Federal prosecutors insist, however, that they are simply "law enforcement actions and are wholly separate" from the negotiations.

The charges allege, among other things, that the company misrepresented its ownership of a Hong Kong-based subsidiary to circumvent American sanctions against Iran, and stole telecommunications technology, trade secrets and equipment from US cell provider T-Mobile USA.

The White House is preparing an executive order to declare a national emergency that would bar US companies from using telecommunications equipment made by China's Huawei and ZTE.

Acting Attorney General Matthew Whitaker was joined by Department of Homeland (DHS) Secretary Kirstjen Nielsen, FBI Director Christopher Wray, Commerce Secretary Wilbur Ross and several USA attorneys for the announcement at DOJ headquarters on Monday.

Meng misled United States banks into believing the two companies were separate, according to the Justice Department.

Behaviors cited by prosecutors in the T-Mobile case indicate that offenses took place from 2012 to 2014, and that Huawei in July 2013 sent out an internal email that "was offering bonuses to employees who succeeded in stealing confidential information from other companies".

Meng - who was arrested at in Vancouver on December 1 at Washington's request - is expected to fight extradition to the United States, amid heavy pressure on Canada from Beijing, whose subsequent detention of two Canadians is seen as an act of retaliation for Meng's arrest.

United States prosecutors allege that Huawei used a Hong Kong shell company called Skycom to sell equipment in violation of the sanctions, and Ms Meng allegedly misled USA banks into believing the two companies were separate, according to the Justice Department.

Canadian Foreign Minister Chrystia Freeland said on Monday that Canada's former ambassador to China had been fired because his comments on an extradition case involving Meng made it untenable for him to stay in the job. A jury in Seattle ruled that Huawei had misappropriated the robotic technology from T-Mobile's lab in Washington state.
