Supreme Court blocks restrictive Louisiana abortion law by 5-4 vote as Roberts joins liberals

"Louisiana is poised to deny women their constitutional right to access safe and legal abortion with an admitting-privileges requirement that every judge in the proceedings below - the District Court, the panel majority and the dissenters - agrees is medically unnecessary", wrote the clinics and physicians challenging the law in their application to the Supreme Court.

In Thursday's decision, justices were asked to look at a Louisiana law that requires doctors at abortion clinics to have admitting privileges at a nearby hospital.

The Supreme Court has just handed down a pair of decisions that illustrate an important truth: Chief Justice John G. Roberts Jr.is not, as many conservatives believe, some kind of traitor to their cause, an unreliable ally who will stab them in the back whenever he gets the chance. And, it could show how these Justices will come down on the greatest issue of our time.

Kavanaugh wrote his own opinion, explaining it was unclear whether doctors would be unable to obtain the admitting privileges were the law to go into effect. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch noted their dissent but did not join the Kavanaugh opinion.

One reason to grant a stay is because there is a substantial likelihood that the Court will ultimately take the case and then reverse the lower court. Some women, especially from the southern part of the state, would have to travel hours to obtain a procedure - an "undue burden", say pro-abortion rights groups.

They argued that even if they were to win later, the impact of the law coming into effect would be irreversible and closed clinics would not be able to reopen.

Kavanaugh said the doctors would continue to be allowed to perform abortions during the 45-day period and would be given leeway by regulators to comply with the law.

The doctors have a 45-day regulatory transition period in which to obtain privileges from hospitals and could bring a complaint at the conclusion of that time if they are unsuccessful, Kavanaugh wrote. "The court should not prevent state legislators from doing the job they were elected by their constituents to do". It would have placed Roberts right alongside the justice who accused the Clintons of running a political hit campaign against his Supreme Court nomination once credible allegations of sexual assault against him surfaced.

She insisted in an October speech on the Senate floor that "his views on honoring precedent would preclude attempts to do by stealth that which one has committed not to do overtly" to overturn Roe v. Wade, the 1973 case that recognized women's right to choose to have an abortion.

Advocates are now asking the supreme court to hear the case next fall.
