Trump Administration Asks Court To Totally Repeal Obamacare

The 2010 healthcare law, seen as the signature domestic achievement of Trump's Democratic predecessor, Barack Obama, has been a flashpoint of American politics since it passed, with Republicans, including Trump, repeatedly attempting to overturn it.

After the Justice Department took that position, federal District Judge Reed O'Connor struck down the entire law and the case is now before a federal appeals court.

The Justice Department sent a letter in support of repealing the entirety of the Affordable Care Act.

Bipartisan majorities of both the House and Senate rejected his move, voting to terminate the emergency before the president vetoed their resolution on March 15. One former official who worked under Sessions told CNN Monday night that he, too, was surprised by the new position.

'The individual plaintiffs do not have standing to challenge the resulting law because they suffer no legal harm from the existence of a provision that offers them a lawful choice between buying insurance or doing nothing, ' they wrote in court papers.

If it were successful, the Justice Department's position supporting the judge's ruling would potentially eliminate health care for millions of people and create widespread disruption across the U.S. health care system - from removing no-charge preventive services for older Americans on Medicare to voiding the expansion of Medicaid in most states. It lets many Americans obtain free birth control, mammograms and cholesterol tests.

What's more, the ACA helps senior citizens afford prescriptions, gives many Americans access to free healthcare services like cholesterol tests and mammograms, and allows children to stay on their parents' health insurance plans until they turn 26.

In the meantime Democrats will try to paint the administration - and Mr Trump - as being in favour of abandoning reforms that have expanded the rolls of those with health insurance and guaranteed that any pre-existing conditions are covered when Americans switch or lose their insurer.

"This lawsuit. threatens the healthcare of tens of millions of Americans across the country, from California to Kentucky and all the way to ME", said California attorney general Xavier Becerra, who has led the fight to preserve the law.

Mueller offers no answer on whether Trump obstructed justice
Sanders declined to comment on whether Trump would invoke the presidential privilege to withhold any information. At least one GOP lawmaker joined Democrats calling on the Justice Department to release Mueller's entire report.

"This lawsuit is as unsafe as it is reckless". In briefs filed with the appellate court, House lawyers said that if O'Connor's ruling were upheld "the consequences will be devastating".

"When will the GOP stop treating health care like it's a privilege for the healthy and the wealthy" she tweeted.

House Democrats, backed by Speaker Nancy Pelosi (D-CA), are slated to introduce new legislation to broaden and enhance the Affordable Care Act.

Although President Trump has railed against Obamacare for years and has frequently called for its repeal and replacement, he and other Republicans have insisted that they support protecting coverage for pre-existing conditions.

Sen. Kamala Harris, one of the Democrats running for president in 2020, addressed the issue on "CBS This Morning" Tuesday.

Tuesday's vote was coming as Trump claimed a different political triumph after Attorney General William Barr said special counsel Robert Mueller had ended his two-year investigation without evidence of collusion by Trump's 2016 campaign with the Russian government.

Since Trump took office, the federal health insurance market, HealthCare.gov, has lost more than 1 million customers. "It would mean reverting our country back to a time when preventative care cost a fortune and it wold mean - once again - limited, lifetime caps on coverage", panel Democrats said in a statement.

"The act is now part of the plumbing of the health care system", Bagley wrote.
