European Union charges German carmakers with blocking emissions cleaning technology

BMW Daimler and Volkswagen were found to be colluding with each other in the preliminary inquiry

"The three auto manufacturers now have the opportunity to respond to our findings", said Commissioner in charge of competition policy Margrethe Vestager. BMW and Volkswagen have yet to comment.

The cartel investigation is also separate and distinct from other ongoing investigations, including those by public prosecutors and other authorities into vehicle manufacturers and the use of illegal defeat devices to cheat regulatory testing.

By participating in a "collusive scheme", regulators said, the carmakers denied consumers the opportunity to buy cars that emit fewer pollutants, despite manufacturers having access to such technology.

"Companies can cooperate in many ways to improve the quality of their products".

The report alleges that between 2009 and 2014, the three companies coordinated to delay or avoid adding particulate filters that would reduce harmful emissions from petrol engines, and from 2006 to 2014 colluded to limit the "exhaust gas cleaning effectiveness" of AdBlue; a chemical additive that is used to remove harmful nitrogen oxides from diesel exhaust.

The finding adds to the vehicle industry's woes after Volkswagen in 2015 admitted to cheating on emissions tests in the US, which led to a worldwide reevaluation of how cars are tested and how to limit emissions to make air cleaner and fight climate change.

The two main components which the commission's complaints surround are the development of Selective Catalytic Reduction (SCR) systems and Otto Particle Filters (OPF).

In the meantime, the European Commission has invited BMW, Daimler and Volkswagen Group to examine the investigation documents themselves and respond to its findings.

BMW said discussions among engineers were meant to improve exhaust gas technologies and that the whole industry was aware of these talks.

"Daimler, VW and BMW may have broken European Union competition rules".

BMW has agreed to pay an 8.5 million-euro fine after an investigation found the company had installed the wrong emissions software in a limited number of vehicles by accident.

The preliminary findings come on the back of a full investigation launched in September 2018, following inspections conducted in October 2017.

The Commission has sent Statement of Objections to the three manufacturers, which it sas does not prejudge the outcome of the investigation. The Commission informs the parties concerned in writing of the objections raised against them.

If, at the end of the process, the commission finds there is "sufficient evidence of an infringement" of the EU's anti-trust rules, they can be fined up to 10 per cent of their annual worldwide turnover.
